 CC&R Violation Process

In an effort to promote community enjoyment, safety, and maintain property values, the POA Board is responsible for ensuring that all member homeowners abide by the POA's rules (CC&Rs).  While the goal is for everyone to enjoy our neighborhood by getting along and following the rules, when that doesn't occur, the CC&Rs provide a process for the Board to address issues.

Complaints: Complaints can arise via Board Member observations and inspections of the neighborhood and/or through member homeowner concerns.  Complainants may submit their complaint by:

  1. Emailing admin@riverroadestates.org, or

  2. Using the Complaint/Violation Form on this website.

 

Violations:  When it is determined that a violation of the CC&Rs has occurred, the homeowner will be contacted by a Board Officer in writing by postal mail or email.

 

1st Violation -

  • explaining the violation and

  • providing a time to correct the offense(s) 

 

2nd Violation -

  • explaining the violation,

  • providing a time to correct the offense(s),

  • and assessing a fine for non-compliance

 

3rd Violation - 

  • explaining the violation,

  • providing a time to correct the offense(s), 

  • assessing a fine for non-compliance

  • pursuing legal action to correct the violation, in which the homeowner is responsible for all POA legal fees

Homeowner's Right to Respond:  The homeowner has the right to respond to the Board regarding any fine or lien assessment within 14 days of the notification.
